Terms of Service

This document explains what you can expect from Shade Diary and what we expect from you. It is not legal advice, and it is not a substitute for a lawyer if you have a question about your own situation. By using the app, you agree to these terms.

What the service is, and what it is not

Shade Diary lets you choose a photo of your own hair, pick one of a small set of colour directions, and see a computer-generated image showing what that colour could look like in your photo.

Shade Diary is a visual preview tool. It is not a colourist, not a formula calculator, and not a prediction of how any hair-colour product will turn out on your hair. It does not tell you whether a colour change is a good idea, and it makes no claim about outcomes, timing, cost, or how any product will behave once applied. If you decide to colour your hair, that decision, and any consultation it deserves, is yours to make.

Who can use this

You must be able to form a binding agreement to use Shade Diary, which generally means you are old enough to do so where you live. The app is not directed at children under 13, and if you are a minor under the age required in your area, you may only use it with a parent or guardian's involvement.

No account

This build has no account, login, or password. Your installation is identified only by a random ID stored on your device. You are responsible for the device you use to access the app and for the photos you choose to submit.

The photo licence you grant us

When you submit a photo to generate a preview, you give us a limited, non-exclusive licence to that photo for the sole purpose of sending it to our server and the rendering provider, generating your preview, and returning it to you. This licence lasts only as long as needed to do that and to meet the retention limits in PRIVACY.md, after which the photo is deleted from our systems on the schedule described there. We do not use your photo for advertising, and we do not sell it. Whether the rendering provider trains its own models on submitted photos is a term we confirm before approving that provider, and it is disclosed in PRIVACY.md once decided.

You confirm that any photo you submit is either of yourself or of someone who has given you permission to use their photo this way, and that you have the right to submit it.

No outcome guarantee

Shade Diary shows you a generated image. It is a visual direction, not a promise. We do not claim the preview matches what happens when a real dye is applied, and we make no health, safety, or chemistry claim of any kind. A preview can be wrong, and how any product performs depends on factors this app does not measure. Use your own judgment, and treat a professional consultation as the source for anything beyond "what might this look like."

Third-party services and Platform Terms

Shade Diary depends on services we do not operate: a rendering provider to generate previews, PostHog for anonymous product analytics, and Apple for distribution and device services. Their own terms apply to the parts of the service they provide. If you install Shade Diary through TestFlight or the App Store, Apple's Media Services Terms and Licensed Application End User Licence Agreement also apply to your use of the app, and where those Platform Terms and this document conflict on a point Apple requires, Apple's terms control.

Intellectual property

The app, its design, and its code belong to us or our licensors. Using the app does not give you any ownership in it. The image you generate is yours to keep, save, and share; we do not claim ownership of the specific preview created from your photo.

Subscriptions and refunds

This build has no subscription, trial, or in-app purchase. Everything in it is free to use for external testers. If a future version of Shade Diary adds a paid subscription, this section is rewritten before that version ships to state the exact price, currency, billing interval, trial length if any, renewal behaviour, cancellation method, and refund policy, consistent with Apple's billing terms for in-app purchases.

Disclaimers and liability

The service is provided as is, without warranties of any kind, to the extent the law allows. We do not warrant that the app will be uninterrupted, error-free, or that a preview will be generated successfully every time. To the extent the law allows, we are not liable for indirect, incidental, or consequential damages arising from your use of the app, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, which for this free build is zero. Nothing in this section limits liability where the law does not allow it to be limited.

Termination

You can stop using the app at any time and delete your local data from Settings, as described in PRIVACY.md. We can suspend or end the service, or your access to it, for a violation of the Acceptable Use section above, or if we discontinue the app or a specific feature.

Changes to these terms

If we change these terms in a way that matters, we update the effective date at the top and, where practical, tell you inside the app before the change takes effect for your next use.

Governing law and disputes

These terms are governed by the laws of TBD — the state or country is confirmed once the contracting entity above is finalized — without regard to its conflict-of-law rules. Any dispute is resolved in the courts located there, unless applicable law gives you the right to bring it elsewhere.
